Terms of Service

1. Acceptance of Terms

By accessing orbitwebdesigns.co.ke, you agree to these Terms. If you disagree, do not use the site.

2. Services

We provide web design, e-commerce, AI agents, and digital marketing services. Specific deliverables, timelines, and pricing are defined in individual project agreements.

3. Client Responsibilities

• Provide accurate content, assets, and credentials in a timely manner
• Own or have rights to all content provided
• Provide valid Daraja credentials for M-Pesa integration (if applicable)
• Respond to approval requests within 3 business days

3. Payment Terms

• 50% deposit to begin, 50% on launch (or per agreed milestones)
• Payments in KES, USD, or EUR via M-Pesa, card, or PayPal
• Late payments may delay launch
• No refunds after project commencement (work performed)

4. Intellectual Property

• Final deliverables: client owns all rights upon full payment
• We retain rights to use project in portfolio (unless NDA signed)
• Third-party assets (fonts, images, plugins) subject to their licenses
• Client responsible for content legality

5. Warranties & Disclaimers

• We warrant work meets agreed specs for 30 days post-launch
• No guarantee of specific business results (traffic, sales, rankings)
• Third-party services (M-Pesa, hosting, APIs) subject to their uptime
• Site provided "as is" — no warranty of uninterrupted access

6. Limitation of Liability

Our liability limited to fees paid. Not liable for indirect, incidental, or consequential damages. Force majeure events excuse performance.

6. Termination

Either party may terminate with 7 days written notice. Client pays for work completed to date.

7. Governing Law

Governed by laws of Kenya. Disputes resolved in Nairobi courts.

8. Changes

We may update these terms. Continued use constitutes acceptance.
